1. Acceptance

By using CapySleep you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the app.

2. Description of Service

CapySleep is a wellness and sleep tracking app for iOS. It helps you view sleep data from Apple Health, record manual sleep sessions with optional motion and audio, set reminders, and review sleep trends. A free version is available without purchase. An optional paid subscription, CapySleep Pro, unlocks additional features. No CapySleep account or sign-up is required.

3. Not Medical or Health Advice

CapySleep is for general wellness and informational purposes only. All sleep metrics, stages, and insights are estimates and are not intended to diagnose, treat, cure, or prevent any condition. CapySleep is not a medical device and does not replace professional medical advice. Always consult a qualified healthcare provider for sleep or health concerns. Do not use CapySleep for emergency or life-saving decisions.

4. Age and Eligibility

You must be at least 13 years of age (or the minimum age in your jurisdiction to consent to data processing) to use CapySleep. If you are under 18, use of the app should be with parental or guardian awareness. CapySleep is not directed at children under 13.

5. Acceptable Use

You agree to use CapySleep only for lawful personal wellness purposes. You may not use the app to harass others, violate any law, or attempt to reverse-engineer or misuse the service. We may suspend or discontinue access if we believe these terms are violated.

6. CapySleep Pro Subscriptions and In-App Purchases

CapySleep offers an optional auto-renewable subscription called CapySleep Pro (annual plan). You are never required to purchase Pro to use CapySleep’s Free plan.

• Free plan: Without a subscription, CapySleep includes limited Free access—currently up to 3 sleep-aid sounds, 3 journal entries, and 3 saved sleep or nap sessions—plus basic sleep views. Apple Music for alarms and sleep aids, full Sleep Details, unlimited history, unlimited journal entries, and recurring schedules require Pro. Feature limits may change over time.
• Free session limits: Deleting sessions, erasing local app data, or reinstalling CapySleep on the same device does not restore used Free session slots. A device erase or Keychain reset is outside this app-level guarantee.
• Billing: Payment is charged to your Apple Account at confirmation of purchase. Apple processes all payments; CapySleep does not collect or store your payment card or billing details.
• Price: The price available in your region is shown in the app at the time of purchase and may vary by storefront, currency, and applicable taxes.
• Auto-renewal: CapySleep Pro renews automatically each year unless you cancel at least 24 hours before the end of the current subscription period. Your Apple Account may be charged for renewal within 24 hours prior to the end of the current period.
• Manage or cancel: You can view, change, or cancel your subscription at any time in your device Settings > Apple Account > Subscriptions, or in the App Store account subscription settings. Deleting the app does not cancel your subscription.
• Restore Purchases: If you reinstall CapySleep or switch devices, you can use Restore Purchases in the app to restore an active subscription tied to the same Apple Account.
• Pro features: While Pro is active, you may access premium features such as the full sleep-aid library, unlimited journal entries, unlimited session history, Apple Music for alarms and sleep aids, full sleep detail views, and recurring schedules. Feature availability may change over time.
• When Pro expires or is canceled: Premium features lock again at the end of the paid period. Your existing sleep sessions, journal entries, schedules, and other app data are not deleted because Pro expired. Premium audio selections may fall back to a free bundled sound until you renew or change them.
• Refunds: Refund requests are handled by Apple under Apple’s policies. CapySleep cannot issue App Store refunds directly.
• Family Sharing: CapySleep Pro supports Apple Family Sharing. When the purchaser enables sharing, up to five family members in the same Apple family group can access Pro through their own Apple Account.

Your use of in-app purchases is also subject to Apple’s applicable terms, including the Licensed Application End User License Agreement (Apple Standard EULA) where required.

7. Limitation of Liability

To the fullest extent permitted by law, CapySleep and its developers are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app or reliance on its data. Your use of the app is at your sole risk.

8. Changes

We may update these Terms of Use from time to time. The "Last updated" date at the top will change when we do. Continued use of the app after changes constitutes acceptance of the revised terms.
